I read on this and other forums that with Re-entry Permit a US resident can live outside for more than 1 year and less than 2 years.

As a H1B holder, can I start a new company and volunteer for it while I am holding a full-time job for the company that sponsors me the visa? I am expecting the new company to gain a profit, of course.:)
Yes you can, start your company and volunteer for the company but not together :(
You can start your own company but can not work in it.
You can take a part time/ 2nd job by filing a 2nd H1 (the 2nd H1 will be in addition to your first H1), but you can't own that company!
Interestingly your wife can start a company and sponsor your 2nd H1 in her company ;)

It looks like you are getting glare from glass or something. Get as close to the glass as you can and the lens as perpendicular as possible. A dark cloth and duct tape to put it up with would get you two things: (1) ability to block glare from lights behind you and (2) hide you from the birds so they settle down.
I've actually put the camera on a tripod and draped a large towel over it and my head/torso for camoflage, which let me stand outdoors and get closer without scaring them away. But I don't do that much because it's really tiring standing there, motionless :)
For the most part, a flash doesn't seem to bother birds much and it's a great help - you get better contrast and a faster shutter.

No that is wrong assumption. H1B can be extended only based on the beneficiary's self I-140 not spouse's
Consult his/your attorney and renew H1B. At least start GC process to be eligible for H1 extension after 6 years

I got approved H1-B notice on 30th Dec 2008 from CSC. My previous expired H1-B date ends with 02/14/2009, but my current newly approved one starts with 02/26/2009. So there is a gap of 11 days between those. Currently I'm on job. Does it really means out-of-status?. Do I need to run February pay check with less hours and officially in vacation?.
Please advice me.

I think that is a mistake either on the USCIS part or on your attorney's part (he/she probably filled out the wrong dates in the I-129). Check your filing docs and ask your attorney to see if he/she can get it corrected.
Since this is a future date, you are not out-of-status yet but, you will be for those 11 days if it is not corrected.

Yes he can , but once 180 days of pending "I-485" are passed then you are free and protected by AC21.

Hello, I am an INdian citizen currently workin in the US on an H1-B visa. I need to travel to Europe for leisure in the month of April. I wanted to go to the Bern Consulate to go and get the stamping done for my H1-B renewal on my passport. I wanted to ask if anyone has gone to Bern to get their H1-B stamped and can share their experience?
Also, do you recommend that I go to Canada or Mexico instead? I have heard ppl saying that you should go to your home country or Mexico/CAnada. ANy experiences that you can share with the Canadaian/Mexican US consulates would be appreciated as well.

With the recent implementation by U.S. Citizenship and Immigration Service (USCIS) allowing concurrent filing of Form I-360 Religious Worker Petition and Form I-485 Adjustment of Status Application, most applicants want to know what documents to submit with an adjustment of status (AOS) application.
Persons with a pending I-360 religious worker petition are now eligible to file an AOS application before September 9, 2009. The AOS application is used by persons who are in the United States to apply with USCIS to adjust to permanent resident status.
Along with the Adjustment of Status Application on Form I-485, one must remember to submit:
a copy of the I-360 receipt notice,
two passport style photos,
a copy of the applicant’s passport,
a copy of the applicant’s birth certificate (along with a certified English translation if the document is not in English), and
a medical examination report performed by a designated civil surgeon.
If an AOS applicant has ever been arrested then a court-certified copy of all arrest records and the final disposition of the case is required (excluding traffic tickets).
Individuals between the ages of 14-79 are also required to submit a Biographic Information Sheet on Form G-325A.
The most important thing to remember before sending the AOS application is the filing fee! Do NOT forget to submit a check or money order to the U.S. Department of Homeland Security in the amount of $1010. In the field I94# and expiration I entered I 94 number which is on the white card on the passport and it is the same as the number on my renewed h1 papers.However I entered expiry date from the i94 on the passport,which is oct06 instead of the 010 date in the renewal.
will that be a problem..? CAN I CORRECT IT AFTER I get the reciept no or will thay be able to verify with the latest h1 paper that i94 is valid

It's interesting that people rely on consultants and body shoppers to enter this country and then curse them.
I doubt that so many people would have entered the US if it hadn't been for these very consultants and body-shoppers. Everyone knows that they pay less and take a cut of the salary. People curse them all the time and yet when it's convenient, they'll use them to get things like H1B application, labor substitution, etc. done.
I am on an H-1B visa I had a confusion regarding my wife's case. She is on H4 visa and her H4 visa was extended to September, 2009 when I changed my employer (XXX) last year. However, her passport carries H4 visa which expires in Oct. 2007 (this was through my previous employer, YYY). Both our I-485 are pending and we both received our EAD last month. She wants to use her EAD to work in future.
A twist is that a consultant had filed for her H-1B this April and we don't know if her H-1B came through or not. He is not telling us. We just don't want to deal with that scumbag. Can we just ignore him and forget about it? Since her I-485 is pending she has a lawful status (Pending AOS), right? Please let me know what you think.

Yes, what is this security clearance? I have applied for H1B renewal after 3 years on July 23rd (my receipt date) of 2007, and this still has not been processed and sent. I was told it has been sent for security clearance. I am here in US working without H1B visa after 7 months of my H1B visa expiry while my renewal is still pending as of today (03/07/08). Does anyone have an idea when is this going to be processed and will I ever get my work visa renewed ?

Thanks FactoryMan. I had a similar question. My thought is that if the spouse is a dependent, then it shouldn't matter what status s/he is, as long is it is legal.
The next question is, suppose we apply for EAD, but the spouse's current student status expires before receiving the EAD, do they fall out of status?

Hey people , i need help. as EB-3 is current , my spouse who is on H4 ,applied for change of status(H-4 to F-1) ,so can i file her papers along wth mine in I-485 or not? change of status is in process.

If you can then retract her COS application and include her in 485. But I am not sure how you would go about donig that. Check with attorney.
