A good friend of mine is getting divorced with her husband. The husband is the primary employment based green card applicant and their dates are current.
Will her I-485 be denied after the divorce?
The husband is willing to wait till the green card is approved before the divorce.

There seem to be a positive and negative news this year for EB2s. On the one hand, USCIS surprisingly allocated all their visas last year and that means that EB2 will not receive the (20k/3) visas that they received last year.
On the other hand because of the bad economy, one would expect that the companies will not be hiring as much EB1s and ROW EB2s as last year plus the DOL is expected to make Labor Certs very strict plus there are postings that software jobs wont make it to EB2.
I would appreciate it if the number crunching gurus can throw any light on how the rest of this fiscal is gonna be like for EB2s.

time like this..... EB backlog so bad........ wait time soooooooo many years......... you really think we care about new H1Bs...................... I say its good the CAP is not filled this year............maybe the corporations will find it difficult to get fresh cheap H1Bs.... then will push congress for Visa recapture........... so they can get skilled man power they need............

I have a question, with the current retrogression and processing dates what is the time for one to get a green card, given that the labor,I-140 being cleared within months, but what is the overall time to wait. Is the process moving forward or is there any improvement ?.

Yes, you can file I140 Premium Processing for a substitute labor. I have done that. Got approved in 9 days.

Sometimes, there are no words to describe someone's insensitivity. You just have to let them express it themselves. So, I give you the words of Reprsentative Steve King (R. Iowa), explaiing why TPS for Haitians is not necessary:

If you are efiling EAD, you dont have to send photo graphs - USCIS will send FP notice to take a picture. That picture will appear on your EAD.
It is required that you send photos for your ead as they put your picture on the actual ead card. I did not apply for AP so I am not sure about the requirements for that. Good luck to you.

Have you tried contacting your local congressman or senator's office? Many times, a request to take action on a pending case from a congressman's office has much better effect than a service request or infopass.

Thanks for the quick reply. I was reading that getting approved I129 means you are cap exempt for next 6 years. As the petition for visa was filed in 2007, so according to this cap exemption should be for next 6 years i.e. 2013. Would be really nice if you can clarify this.

I want to apply for my 3 yrs H extension using preminum processing. Can i do that by just using the email confirmation from USCIS that I-140 petition was approved? My 1-140 petition was approved in Dec,2006 and still have not recived my approval notice.

If I recall correctly, you need to send a copy of approved i140 to request 3 years extension.
