Few months ago, my company filed for my 7th year extension and USCIS approved the extension for only 8 months instead of 1 year (my I-140 hadn't been approved yet). My lawyers contacted USCIS for clarification and we finally heard back from them. They say that the approval of 8 months is correct and gave no explanation for why it was not for 1 year (which I would have qualified for since my LC was approved when the extension was filed).

Has anyone else experienced a similar thing?

Once every check is completed it goes into a queue and then every month a list goes to an officer based on the priority date and visa availability

The best thing is to call them as soon as the processing dates go past your application date. Call them to find out about ur case. At that time they are open about ur case. They will let you know exactly if your name check is cleared.

They also mentioned that once everything is in place the files goes to the office and then it might take up to 90 days for the officer to make a decision.

Hi IV friends-

I am preparing to apply for my EAD througth E-file online. I am on H1-B currently and my I-485 was filled under my husband's EB2 application in July 2007. I did apply for EAD at the same time and got approved EAD for a year but never used and it it expired in December 2008. Now My H-1 B cap will reach in March 2011 and want to go on EAD ASAP so I can save the remaining time on H1-B ( advised by my company lawyer.) . My questions -

Should I apply for reneal of EAD or new EAD?

How difficulat is it to apply online? Do I need to send coyp of my H1-B etc as supporting deocument?

It should be applied at the service center where your 485 is pending currently. Attach copy of 485 transfer notice with other required documents.

Can Gurus please help me with this:

Where do I mail out the packets for EAD and AP renewal (paper extensions)? Can you please tell me whether the packet should be mailed to a service center where previous EAD and AP were approved or whether it depends on the state I live in?
Please note, my original EAD, AP and I-485 were sent to NSC which were transferred to TSC internally (by USCIS) and now my I-485 is pending in TSC.

Any help is appreciated.

ICE assistant secretary John Morton announced that the government would no longer detain them if they can prove their identities, are not dangerous or a flight risk, and have a credible fear of persecution or torture in their home countries. http://bit.ly/4LM3F1

But it might be a tad early to celebrate.


The details of the plan are not yet clear. As Professor Regina Germaine of the Georgetown University Law Center observed in an email message to an Immigration Professors' Listserve, "the criteria for release has always been (since 1996) the 3 factors mentioned by John Morton - 1) ID, 2) not a danger or flight risk, and 3) credible fear. And the lack of one or more of these factors is cited when ICE refuses to release someone."

So, has Morton announced a new policy or has he simply restated the existing policy in a way which suggests release, but, in fact, will lead to continued detention of asylum seekers?


Another unanswered issue is whether the policy will be followed by ICE officers throughout the country. Professor Margaret Taylor of Wake Forest University suggests it's an open question. "Hopefully there will be 'buy in' and compliance in the field offices with this policy, but history suggests otherwise."


For now let's take the Administration at its word. But time will tell whether the draconian policy of incarcerating people who seek refuge in America has finally come to an end.

Guys:
Our( my wife of H4 and me on H1) currently have visas stamped till end of Feb'07.

Now, I am going to file for my extension.

The question is that if my wife travels out of US before end of Feb, according to my lawyer we do not need to file foe her extension.

When she is to come back the lawyer says that she would get her H4 visa based on either my pending application or approved extension.

Is this possible, that without filing for her extension she can get her H4 in Delhi stamped, based on my extension application..??

Please share your thoughts.. I am perplexed..!!!

Looks like the lawyer gave you half baked suggetion.
If she is leaving the country before her current I94 expiry then you do not need to file extension for her, but she needs to get H4 visa stamped before entering US, she can get a Visa stamp only with your H1 approval document only and not the extension pending application, which means she cannot get back into teh country until your H1 extension approval

I am July 2 filer and I called yesterday and they gave me this BAD news. They said "Other reasons". I can't think of what they could be. They said they are sending application back which I did not receive yet.
Any one here unlucky as me unfortunately? Anyone have came across this situation? Your help will be greatly appericiated.

I have I140 approved this year in March from NSC with EB2 category. My Employer sent I485 package with various checks I guess and our medical exam results.

My mother-in-law would like to get visitor visa.

How do I answer #37 of the DS-156?

The applicant's (my mother-in-law) son( my husband) is in the U.S. illegally. I am US cit. and my husband needs to report to visa interview within the next year. We have been post-poning due to medical issues. In the meanwhile we hope my mother-in-law can come here to visit her granddaughter.( I am unable to travel). #37 of the DS-156 asks if any body is in US. We should answer YES, because her son is here, BUT, what do we put for his status? Illegal? I read one article that stated to mark YES only if he has legal status. I do not want to put NO, immigration already knows he is here and we do not want to be dishonest.

Any ideas?


She has to be truthful. Otherwise it can create big problem later. Why you husband did not apply for the card when married to a citizen?

I am planning to complain against my employer for not paying bench pay. He says he can prove that I never reported to him. I got my status changed from H4-H1B since October2008. He already got a signed leave letter from me . Now I would like to come back to legal status. When I make a complaint to DOL how can I prove that I worked for this employer. I never visited their office personally. All the communications happened through phone and email.
We had many e-mail communications between October to till-date. Is this enough to prove my case? How can he defend himself saying that I never reported to him. I am genuine candidate with real experience and never faked my resume. I am ready to face any legal issues. Please guide me how to proceed.

Thanks! We filed today.. they'll will receive tomorrow.

My 485 is pending, so I think I won't be totally out of status..

Any suggestion on how we can approch sending the approved LCA later and ask USCIS to match it to the already submitted H1B petition?

I dont see a problem if you have I 485 Pending ( i assume you have EAD to continue working )

I filed my H1B 3 months later after joining a new job on EAD , i didnt have any problem
