I have a very complicated case, and I need some answer that can release me from all this stress.
I came to the United States country in 2007 with a F1 visa. I won a scholarship sponsored by the government of my country to complete a bachelor degree. I was sent to a community college to improve my English skills. I finished my associated degree at the community College last spring 2009. Since my school only issued the I-20 until June 2009, my visa was also issue until that date. Therefore, my visa is already expired. However, already got accepted into a 4 year college and I am starting in Fall 2009, so I am still under F1 status.
The institution that is sponsoring my scholarship agreed to pay for my bachelor. However, they are requesting all scholarship students to change their status to j1 by the beginning of spring 2010. If I don't do it, I will lose my scholarship and therefore my status since I don't enough money to pay for the very expensive tuition. The institution wants us to go back for two years after we finish our bachelor, so they forcing us to change our visas.
I have been living with my girlfriend since last year. She is a Permanent Resident since 2003 . She is planning to apply for citizenship on February 2010. We are planning to get married by the end of this month (August). I need to go back to my country to change my status to j1 by the end of the fall semester, so I can keep my scholarship.
Here are my questions:
Might getting married now increase the risk of been rejected when apply for J 1 visa?
When would be the best time to get married?
When would be the best time to apply for green card? (Summit I-130, I-485, I-765 and G-325)
My fiancee and I don't have any problems with me going back for 2 years after I finish my studies, as long as I come to visit her about 3 or 4 times in the period of 2 years.

I have no US visa stamped in my passport and planning to fly Emirates to India via Dubai. I will use AP for re-entry. Do I need transit visa at Dubai like London and other European Airports? Response from anyone with experience will be appreciated. If already discussed here, guidance to particular forum will help.

I live in GA. My 485 was filed at NSC and was receipted at CSC and transferred back to NSC.
As per the filing instructions, I will have to file EAD at Texas Service Center.
But some folks told me to file at the location where I-485 is pending.

I am working for Company A on a full time basis on H1B and part-time with Company B(non-profit) on a concurrent H1B. I filed for my GC with Company A and I-140 is approved and applied for I-485 and got EAD/AP also.
My H1B with Company B is expiring and the 6 year term will end on December 31, 2009. I am planning to apply for H1B extension for this H1B and the company attorney says I can get it extended based on Company A I-140 because it is a concurrent H1B. How far is this true? Can I extend my Company B H1B based on the approval on Company A H1B?

Hello,
I am one of those cases where no one can get my name right. This time my visa stamp has an FNU against my first name.
I have a valid SSN, valid California DL and a valid California marriage certificate. The I-797 is not a blanket petition. It has my name as I wish it to be. I used my I-797 to get my DL couple of years back.
The question is, will the FNU create any problems at the port of entry? Will it create problems when I renew my H1-B later this year?
How would I enter my name on the I-94? As on the petition or as on the visa?

Is that true, or is he just trying to scare me into using HIS service? I've read the ENTIRE text of the International Marriage Broker Regulation Act (it's not a very big statute to read; it's a subsection of a much larger act), and it never says anything about how I should get denied to sponsor my fiance's visa because my BROKER didn't conduct the background checks.
I wouldn't be this concerned if it weren't for the fact that there are very few sites that seem to comply with IMBRA's criminal background check regulations. I have no problem telling the woman that I'm not a criminal (I've got nothing to hide), but why should I be denied the right to marry her, forever and ever, with no recourse, since the damage has already been done, because my BROKER messed up?
The only negative consequence I've read in this act is that the broker has to pay a fine if he doesn't conduct the background checks. Whoopdie doo! What does that have to do with me?! As long as I get the visa for my soul mate, I could care less what happens to my broker; he's done his job as far as I'm concerned.
Is my intuition correct? If that web page is true, can you refer me to the exact clause that states that meeting via a non-compliant broker constitutes an automatic visa rejection?

Standard Test include:
1. Blood test
2. TB skin test ( if this is +ve , then X-rays are done).
3. Immunization : Tetanus, MMR and vericela ( chickenPox)
If you donot have record, you can get these shots again.
If you remember ( or confirm with parents) that u had chickenpox in past , then they can confirm this by bloodtest and u will not need shot.

Hi, I am in 8th year of H1b with 140 approved (EB3) from company A. I would like to switch to company B and planning to start EB2 quickly to enage a new interesting project . F1 requires a intent of non-immigration. By filing I-140 you already showed intent to immigrate (labor approval alone will not be considered intent to immigrate). You will not be able to get COS to F1 from H1B. Even if USCIS grants your COS by mistake you will have hard-time getting a VISA at an American Embassy.
So in this case if somebody wants to study for an MBA full time, and at the same time not loose H1 (more importantly GC status), what are the options. Sometimes it is possible due to bad economy, getting a job may be hard, which is an opportunity to get some degree.

I am in strange situation. I am in 7th year of H1B and I have applied for H1B extension which was expiring on April 4th through my company on Feb 14th through normal processing. I have the LIN number from receipt notice. I was never able to check the status online as the LIN number was not found and when attorney called USCIS regarding this on March 23rd, We were told that the information will be updated to see the status online. Our attorney did not follow up with USCIS since then. Our attorney followed up again just today and found that an RFE was sent on March 25th which was never received by attorney. Currently we do not know what exactly is requested in the RFE or dead line for the response. RFE was requested again today from USCIS and was told that will be received in around 30 days. Do you think new dead line will be given for the RFE as the initial deadline might have passed for the initial RFE. I am not sure what to do at this point if I am in status or not. Please provide your advise as to what I should be doing? Appreciate your advises.

My husband is in the same position too.He is a fellow and got a job to start in 2008 july.lc dne.i 140 pending..
Can he file for i 485....ead for a future job...this has been in our head since this evening....cant wait till tomorrow morning to ask the lawyer:rolleyes:
