Thanks for the reply. I've also got canadian immigration as a backup and my visa is valid till April 20. I was planning to go to canada and come back to US on parole but my friends advised me to wait as from march bulletin it looks like my PD for Oct 05 will become current hopefully in the next bulletin. I was told that I might put the US case in risk as you never know what could happen when you come back.
What do you guys suggest?

My second 140 may be approved by this month end.. Neb-Nov. 08-filing... i am hoping i will be able to port my PD..to 12-05
Now..in case i lose my job... and since i am in my 9th yr-h1..which expires may-2010..
suppose ..i cant find a job ...and if i have to leave US.....(but my employer agrees not to cancel my 140)
a.) what should i do to retain my GC process?
b.) How do i switch to CP processing....

You need to file I 824 form and let USCSIS know that you want to transfer your case to consulate. If you are from Mumbai consulate area then u can do AC I 140. becasue I 824 can take 1-2 years to transfer your details.
While in AC I 140 you just need receipt of I 824 and attorney certified package. More details you can get on internet. If you PD is near to current then u can initiate this process and thus with in 3-4 months if PD become current you can get visa interview. Generally they dont ask for hard ship reason for AC I 140 but in your case you can explain about your wait time and impact on your career etc..

Hello,
My friend has H1 and working for company A. He transferred his H1 and started working for company B (Its been 4 weeks and he has 2 paystubs from company B).
He is sure that company A didn't revoked / cancelled his H1. Now he wants to move to company A (old one). Is this possible?
or does he need to re-transfer his H1 from copnay B to company A?
Please advise.

He/She can join old company as long as H1b from the old company is not revoked. There is no need for any H1b transfer as long as old company's H1b is valid. Just go and join them back if they are willing to take him. Lot of people of H1b do this. Hope this helps.

Company "A" had filed my H1B transfer after I accept their offer. I signed the offer letter
In offer letter no where it is mentioned that if I leave company , i have to pay H1B transfer expenses.
Also It is clearly written without any reason , time either way can terminate job. This is below from offer letter..
"I have read and accept this employment offer. I understand my services under this agreement will begin with the successful transfer of my H1B. I understand my employment is terminable at will, i.e., and either company or I may terminate the employment relationship at any time, with or without cause."
Now , I have a better offer ,I am not joining that company .
They are asking me for H1B transfer expenses.
Company is asking "You signed and agreed to become an employee, however you never even started working here to begin an employee/employer relationship also you keep delying your joing time..It is clear that the delays were a stall tactic and completely dishonest, which any court will agree with."
If I am not paying it, they are going to take legal action ..
Please let me know your thought or any lawyer can help me in case company files legal action and what will be charges

You will not get new I-94 for travel to Canada less than 30 days.

I dont see any rule set for AP renewals..But on a safer side 120 days in advance and based on your travel needs..

This is pretty confusing to me as to what I am can and cannot do with an EAD/AP combination. Right now I am on an H1-B visa. What are the major differences from getting a green card, other than the fact that if the green card is rejected for some reason, I would have to leave the country For example, on EAD/AP, can I:
1. Quit my current job and sit at home, and do nothing?
2. Start a company?
3. Go to Full time MBA school?
4. Go to part time MBA school with my current job?
5. Switch jobs as many times as I want using AC21?

If she comes back on H4 she can not start working until another h4-h1 (cos) complete. It is really your personal choice and how confident you are about your wife's successful h1b stamping at home consulate.

I suppose it depends on how you plan on using your next camera body.
For me, I bought a second D100 body (I shoot weddings professionally) even though I could have bought a D70, a used D1X or even waited for the D2X or the fabled D200.
Why? Well, in my case, I wanted a backup camera that could be used as a second camera at the same time. Not having to think about the differences in controls and settings when switching from camera A to camera B made buying a second D100 an easy choice. Plus, I bought the second D100 used for $825. It was in mint condition although it had over 11,000 actuations on it. A new D100 right now is running around $1100 after rebate, so that's not bad either!
If you want to be able to swap cameras without a second learning curve, get another D100. If you want something totally different (but not quite) get a D70. Or, just wait and see if Nikon will come out with the replacement for the D100. But you could be waiting for a while! :)

My Employer agrees to files the AOS papers and forwarded to attorney but attorney is not yet agreed to proceed with the processing. He was telling that there is risk in this and need a close attention.
Any advice appreciated.
