Please forgive me if these kind of posts are not allowed (Admins, feel free to remove this post if this is not the correct forum).
I am getting ready to apply for PIO for our new born (born in US) but one of my friend mentioned about applying for OCI instead.
The information on eligiblity for OCI in the NewYork consulate website is little confusing. My question is since me and my wife hold Indian passports, would my new born be eligible for OCI?
Also is there something called CIO (Not Chief Information Officer)?

I know a colleague of mine who also changed from L1 to H1 last year but he joined his new job after 2 months from Oct 1 .
I have also read that only when you go out of the country and when you stamp your visa thats when one of the visa goes invalid.
Is this right?

You are already out of status as you are not on L anymore. As of october 01st, your status changed to H-1b and you can only be employed by your H-1b employer.
Talk to a lawyer who knows L stuff (not many do) and straighten things out.

This is a recent USCIS update announcing that any U.S. citizen seeking to adopt a Nepali child, whose case is not affected by the suspension of processing cases involving Nepali children claimed to have been found abandoned, should file the Form I-600 with the U.S. Embassy in Kathmandu.
This change in the filing location for the Form I-600 petitions applies to two groups of prospective adoptive parents who are not affected by the suspension. The first group is those who received a referral letter from the Government of Nepal�s Ministry of Women, Children and Social Welfare before Aug. 6, 2010, informing them of a proposed match of an abandoned child. The second group is those who seek to adopt Nepali children who were relinquished by known parent(s) and whose identity and relationship can be confirmed.
USCIS strongly encourages prospective adoptive parents to follow this procedure for their own benefit, based on growing concerns about unreliable documents, irregularities in the methods used to identify children for adoption in Nepal, and the resulting difficulties in classifying those children as orphans under U.S. immigration law. I came across a posting today for a local contract position, which was a good match for my profile. But when I sent my resume in, the vendor said we cannot proceed because the end client asked for either citizens or GCs. I thought it was strange, because it is a contract requirement, not fulltime. This is the first time that I have encountered someone requiring a GC for a contract posiiton. Further, this is not a defence or state department kind of deal where you'd need citizens. I would understand if they said 'citizens only', but GC or citizen does strike me as unconventional.
Can someone please advise if this is allowed by law?
Yes it is legal. They are merely giving preference to citizens and permanent residents, and it is line with the department of labor regulations. They cant however discriminate between H1-B from different nationalities.
Also, they might have a project stipulation where they do not want any uncertainity as to how long they can keep the contractor.

I recently found out that someone had stolen my credit card information to purchase items online. I have since then closed that credit card and went ahead and put a fraud alert for 90 days on my credit report. I don't believe my SSN was stolen, but I want to check my credit report and also for protection have the alert so that no one tries to apply for loans etc. using any of my information.
Will having the fraud alert have an impact on my 485 filing in any way? Let me know what the best process is to handle this if it does have an impact on 485 background checks, and pending green card approvals etc.
I have no criminal history.

Fraud alert does not go into your permanent credit report. All this does it is that when you try to open a new loan/credit account, the lender will see that there is a fraud alert on your profile and may call you to verify. It should not have any effect on your I-485.

Can the work experience without H1B be countable when you apply for I140 (EB2, BS + 5yrs ) ?
I kept my part time job about 3 yrs while I was working as a full timer at other companies. But the problem is I was getting paid but didn't file H1B as a part timer. I know that I should have filed for H1B but I just had a H1B as a full timer with my other company. If I can count my part time work experience ( 3yrs part time / 2 = 1.5 yrs as full time) along with my full time experience (3.7 yrs), It exceeds 5 yrs of related work experience that requires for EB2.

Hi,
I'm trying to schedule my visa stamping date in aug /sept time frame in India. In delhi consulate when I click on Indian resident I see the available dates but when I click on Indian citizen residing in US, I see no availability. I'm not sure which option should I choose. I'm a student working on OPT in US. My OPT will expire on Aug 4th and so I will come to India. I'm not sure which of the two options I have to choose while scheduling an interview :
Resident of India/Bhutan
OR
Indian Citizen residing in United States.
I would really appreciate any help in this matter.

Company B applied H1B tranfer petition for me two weeks back. Our documents went to USCIS, and we didnt received receipt notice yet. To my surprise the filing fee check is also not yet encashed.

You should take the advice of an attorney. I would recommend Rajiv Khanna. His website is immigration.com. In case india is the only option, you get lactose free stuff as well.

Even I am very worried about the same as my filling for H1 extn is going to come soon and due to the recent denials, I am very worried. I don't have EAD also with me and my priority date is very late. I heard about 3 cases where H1 extn is denied.

I was able to file for 485 during the summer of 07, have an EAD but never used. I got married later, and my spouse is currently on H4. I have to maintain the H1 to support the H4. I have a very good opportunity to move up in my job - Is there a way use my EAD and still support legal stay of my spouse?

I am in the same boat. Filed July 19th . As of Last Friday not in the system.
No checks cleared. All the guys who filed with me got their receipt last week from Texas. I am the only one remaining. My I140 was approved from NSC.

If my priority date is current as of November bulletin, do I have time
until 30th November to mail the I-485 application?
Or does the DOS need to have received the application on or before 30th November?
And if I am in California, where does the I-485 application physically go?
[Its a long story why I didn't when the doors were open in July-Aug]
